Why is the Insurance Industry Spending Millions to Promote Caps?  Because they will Save Millions More if they don’t have to Pay for Mistakes.  The Proof?  In States with Caps, Malpractice Insurance Rates are Still Going Up! 

The data proves that capping patients' recovery from medical mistakes will not reduce malpractice premiums. According to information obtained from the insurance publication Medical Liability Monitor (October 2003), the average liability premium for doctors practicing in internal medicine was 14.7% higher in states with caps on damages than in states without caps in the year 2003.  That same publication reported that the average liability premium for general surgeons was 22.9% higher in states with caps than in states without caps.  And finally, the Medical Liability Monitor (October 2003) found that malpractice premiums for OB/GYNs was 12.3% higher in states with caps than in states without caps last year. The medical and insurance communities are demanding that legislators take away patients' constitutionally protected rights to recovery from medical error even though they recognize that caps will not lower insurance premiums but will provide substantial profits for the Insurance Industry.
